Terms of Service

Effective October 8, 2026 · v2026-10-08

The agreement for using Analytics Power: accounts, your data, subscriptions and renewal, cancellation, and our responsibilities.

1The agreement

These Terms of Service (the “Terms”) are an agreement between Coastal Carolina Tech (“Coastal Carolina Tech”, “we”, “us”) and the organization that creates or joins an Analytics Power workspace (the “Customer”, “you”). They govern your use of Analytics Power, the hosted analytics service at analytics-power.com, its console and APIs, and any connector software we provide (together, the “Service”).

If you accept these Terms on behalf of an organization, you confirm you have authority to bind it. If you and we have signed an order form or other written agreement for the Service, that document controls where it conflicts with these Terms. The Acceptable Use Policy, the Data Processing Addendum and the Privacy Policy form part of this agreement.

2Accounts and workspaces

  • You sign in with a passkey. There is no password. You are responsible for the devices that hold your passkeys and for keeping any recovery codes we issue somewhere safe.
  • A workspace’s owners and admins decide who is invited and what role and data sources each member gets. You are responsible for everything done under your workspace’s accounts, and for making sure your members follow these Terms.
  • Give us accurate account information and keep your contact email current.
  • Tell us promptly at matt@coastalcarolinatech.com if you believe an account has been used without permission.

3Acceptable use

You agree to use the Service in line with the Acceptable Use Policy. In short: only connect data you are entitled to use, do not attack or overload the Service, and do not use it to control equipment or as a safety system.

4Your data

“Customer Data” means the data you or your members put into or make reachable through the Service: data source registrations and connector settings, the data those sources return, the questions you ask, the answers, charts and reports produced from them, the metric definitions you approve, and the audit ledger of your workspace.

  • You own your Customer Data. These Terms give us no ownership of it.
  • You grant us a limited license to host, process, transmit and display Customer Data only to provide, secure and support the Service for you, and as you otherwise instruct us.
  • We do not sell Customer Data, we do not use it for advertising, and we do not use it to train artificial-intelligence models.
  • We may use aggregated, de-identified information about how the Service is used (for example, request counts and error rates) to operate and improve it. It will not identify you, your members or your data.
  • You are responsible for having the rights and permissions needed to connect each data source and to let us process its data. The Service is designed for read-only access; we strongly recommend connecting it with database accounts that can only read.

When we process personal data on your behalf, we do so as your processor under the Data Processing Addendum.

5AI-generated content

Answers are computed by queries run against your data under the metric definitions your workspace has approved. Some features use a large language model to interpret a question or to write a short narrative summary of a result (see Subprocessors for exactly what is sent). Narratives and interpretations can be wrong. Check important results against the query and data shown alongside them before relying on them. The Service is a decision-support tool; it is not a control system and must not be used as a substitute for safety systems, engineering judgment or regulatory compliance processes.

6Free trial

New workspaces may start on a free trial for the period and with the limits shown when you sign up. A trial is provided “as is”, without any service commitment, and may be changed or ended by us at any time. When a trial ends, you can subscribe to keep using the workspace. If you do not, we may suspend it, and we may delete a suspended trial workspace and its Customer Data 30 days after the trial ends.

7Subscriptions, fees and renewal

  • Paid plans are billed monthly, in arrears, at the price in your order form: each invoice covers the previous calendar month, prorated for any part of a month the plan was active. Invoices are issued through Main Street Suite, our billing system, and card payments are processed by our payment provider, Stripe; we do not receive or store full card numbers.
  • Subscriptions continue month to month until cancelled.
  • You can cancel at any time by emailing us, or by deleting your workspace. Billing stops on the day the cancellation takes effect, and the final invoice covers only the days before it.
  • Fees are non-refundable except where these Terms or applicable law say otherwise.
  • We may change prices for future billing periods by giving you at least 30 days’ notice. A change takes effect at your next renewal, and you may cancel before it does.
  • Fees exclude taxes, which you are responsible for (other than taxes on our income). If a payment fails and is not resolved within 14 days of our notice, we may suspend the workspace until it is.

8Suspension

We may suspend access to all or part of the Service if (a) your use breaches the Acceptable Use Policy, (b) it poses a security risk to the Service or to others, (c) payment is overdue as described above, or (d) we are required to by law. Where practical we will tell you first and limit the suspension to what is necessary, and we will restore access promptly once the issue is resolved. Suspension does not delete your Customer Data.

9Confidentiality

Each party may receive non-public information from the other (“Confidential Information”). Customer Data is your Confidential Information. The receiving party will use the other’s Confidential Information only to perform under this agreement, protect it with at least reasonable care, and share it only with personnel and service providers who need it and are bound by similar obligations. This does not apply to information that is or becomes public through no fault of the recipient, was already known to it, is independently developed, or is rightfully received from a third party. A party may disclose Confidential Information when legally compelled, after giving the other party notice where lawful.

10Security and subprocessors

We maintain administrative and technical safeguards designed to protect Customer Data, as described on our Security page. We use the service providers listed on Subprocessors and remain responsible for their performance of our obligations.

11Our intellectual property

The Service, its software, documentation and branding belong to Coastal Carolina Tech and its licensors. Subject to these Terms, we grant you a non-exclusive, non-transferable right to use the Service for your internal business purposes during your subscription. If you send us suggestions or feedback, we may use them without obligation to you.

12Warranties and disclaimers

Each party warrants that it has the authority to enter into this agreement. We warrant that we will provide the Service in a professional manner and that it will perform materially as described in its documentation. If it does not, tell us and we will use reasonable efforts to correct it; if we cannot, you may terminate the affected subscription and receive a refund of prepaid fees for the remaining period.

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of any AI-generated content. We do not warrant that the Service will be uninterrupted or error-free.

13Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, production or data, even if advised of their possibility. Each party’s total liability arising out of or relating to this agreement is limited to the fees you paid us for the Service in the 12 months before the event giving rise to the claim (or US $100 if you have paid nothing).

These limits do not apply to your payment obligations, to either party’s indemnity obligations, to breach of confidentiality, or to liability that cannot be limited by law, including for gross negligence or wilful misconduct.

14Indemnity

We will defend you against any third-party claim alleging that the Service, as we provide it, infringes that party’s intellectual property rights, and pay the resulting damages and costs finally awarded or agreed in settlement. This does not cover claims caused by Customer Data, by your combination of the Service with things we did not provide, or by use in breach of these Terms. If such a claim is made or likely, we may modify the Service, obtain the right for you to keep using it, or terminate it and refund prepaid fees for the remaining period.

You will defend us against any third-party claim arising from your Customer Data or from your or your members’ use of the Service in breach of these Terms or the Acceptable Use Policy, and pay the resulting damages and costs finally awarded or agreed in settlement.

The party seeking defense must notify the other promptly, give it control of the defense and settlement, and provide reasonable cooperation.

15Term, termination, and your data afterwards

  • This agreement lasts as long as you have a workspace with us.
  • You may stop using the Service and close your workspace at any time by cancelling your subscription and asking us to close it.
  • Either party may terminate if the other materially breaches this agreement and does not cure the breach within 30 days of written notice.
  • Export window. For 30 days after termination you may ask us at matt@coastalcarolinatech.com for an export of your Customer Data held in the Service (registrations, approved definitions, saved reports and your audit ledger) in a standard machine-readable format.
  • Deletion. After the export window we delete your Customer Data from the Service within 30 days. Residual copies in backups expire on their normal cycle. We may keep records we are required to keep by law, billing records, and the record of your acceptance of these Terms.
  • Sections that by their nature should survive termination (including 4, 9, 11 to 14, 16 and 18) survive it.

16Governing law and venue

This agreement is governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. The state and federal courts located in North Carolina have exclusive jurisdiction over any dispute arising from it, and both parties consent to their jurisdiction. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or Confidential Information.

17Changes to these Terms

We may update these Terms. The effective date at the top of this page always shows the version in force. For a material change we will tell you by email or in the Service at least 30 days before it takes effect, except where a change is required by law. After a change, members are asked to accept the new version the next time they sign in. If you do not agree, you may cancel before the change takes effect and we will refund prepaid fees for the remaining period.

18General

  • This agreement is the entire agreement between us about the Service and replaces prior discussions.
  • Neither party may assign it without the other’s consent, except to a successor in a merger, acquisition or sale of substantially all of its relevant assets, with notice.
  • Neither party is liable for delays caused by events beyond its reasonable control (other than payment obligations).
  • If a provision is unenforceable, the rest remains in effect. Failing to enforce a provision is not a waiver.
  • Notices to you go to your workspace owners’ email addresses; notices to us go to matt@coastalcarolinatech.com.
  • You will comply with applicable export control and sanctions laws in your use of the Service.
  • The parties are independent contractors.
